Welcome to WarmHands. These Terms and Conditions ("Terms") govern your use of our website warmhands.co.za ("the Site") and any purchase you make from us. By accessing the Site or placing an order, you agree to these Terms. Please read them carefully. These Terms operate alongside — and do not limit — your rights under the Consumer Protection Act 68 of 2008 (CPA) and the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

2. Products
We make every effort to display our products, colours, and descriptions as accurately as possible. Product images are for illustration and slight variations in colour or appearance may occur due to screen settings or manufacturing. We reserve the right to update, change, or discontinue any product at any time without notice.

3. Pricing
All prices are shown in South African Rand (ZAR) and include VAT where applicable. We make every effort to ensure prices are correct, but in the event of an obvious pricing error, we reserve the right to cancel the order and refund any payment made. Prices may change at any time, but changes will not affect orders already confirmed and paid for.

4. Orders
When you place an order, you will receive an order confirmation by email. This confirms we have received your order, it does not guarantee acceptance. We reserve the right to refuse or cancel any order, including where there is a suspected fraudulent transaction, a pricing error, or stock is unavailable. If we cancel an order you have paid for, you will receive a full refund.

5. Payment
Payment is processed securely through our third-party payment provider (PayFast). We do not store your card details. By placing an order, you confirm that the payment method used is your own and that you are authorised to use it. Orders are only processed once payment has been confirmed.

6. Delivery
We deliver nationwide within South Africa via our courier partner. Estimated delivery timeframes are provided on our Shipping Policy page and are given in good faith but are not guaranteed, as courier timelines can be affected by factors outside our control. Please refer to our Delivery/Shipping Policy for full details.

7. Returns & Refunds
Your rights to return items and receive refunds are set out in full in our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms limits your statutory rights under the CPA and ECTA, including your right to cancel an online order within 7 days and your rights regarding defective goods.

8. Your responsibilities
You agree to provide accurate, current, and complete information when placing an order, including a correct delivery address and a contactable phone number. We are not responsible for delays or failed deliveries caused by incorrect or incomplete information provided by you.

9. Intellectual property
All content on this Site — including logos, text, images, product descriptions, and branding — is the property of WarmHands or its licensors and may not be copied, reproduced, or used without our written permission.

10. Limitation of liability
To the fullest extent permitted by law, WarmHands shall not be liable for any indirect, incidental, or consequential loss arising from the use of our Site or products, except where such liability cannot be excluded under South African law, including the CPA. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, or for fraud.

11. Privacy
We respect your privacy and handle your personal information in accordance with the Protection of Personal Information Act (POPIA). We collect and use your information only to process orders, deliver products, and communicate with you. Please refer to our Privacy Policy for full details.

12. Governing law
These Terms are governed by the laws of the Republic of South Africa, and any disputes shall be subject to the jurisdiction of the South African courts.

13. Changes to these Terms
We may update these Terms from time to time. The version published on this Site at the time of your purchase is the version that applies to your order.
